Terms & Conditions

Please read our Terms and Conditions carefully as they form a contract between us and you. Your acceptance is confirmed when you approve verbally, by email, Skype message, or by making an initial payment toward the cost of the project.

We have made these Terms and Conditions brief, easy to understand, and as straightforward as possible. If you have any questions, please feel free to contact us.

Terminology

  • You – (‘the Client’)
  • Us or We – (Hawkdive Technologies Private Limited, hereinafter referred to as ‘the Company’)
  • The Project – The body of work assigned by you that is being undertaken, normally consisting of several connected parts such as consultation, website development, hosting support, and website maintenance services, including themes, templates, and third-party plugins.

 

Project Terms

 

Web Development/Designing

 

  • All quotes/estimates are based on the requirement submitted by you and our understanding of your requirement within the given timeframe. Any additional features, design modifications, or paid plugins may incur extra costs.
  • By accepting a quote, you agree to and accept these Terms & Conditions. Your acceptance may be verbal, via email, by signing a quote, or by making any initial payment toward the cost of the project.
  • Clients must provide clear instructions regarding website development or design. Ensure all your requirements are included in the quotes/proposals/estimates before accepting them.
  • You are responsible for providing content such as text, images, videos, and other website materials. Website development/designing does not include content writing, logo design, or video production unless specifically mentioned. Minor changes in images or text may be done free of charge, but extensive edits are billed separately.
  • Content Accuracy & Copyright: Ensure all submitted content is free of errors and copyright violations. We provide free stock images, but you must ensure your provided content is original.
  • Project Review & Payments: Review the submitted work and make the final payment on time.
  • For Outsourcing Agencies or Consultants: If you outsource a project to us, you are responsible for full payment, regardless of any third-party client payment delays.
  • Post-Development Support: We offer one month of free support, including guidance on website features. Minor changes (less than an hour’s work) are included.
  • Delays from Your End: Failure to provide necessary information may delay the project and impact deadlines.
  • Bug Fixes: Any bugs (programming errors) reported during or immediately after development are fixed free of charge. However, major design/layout changes after approval will be billed separately.
  • Project Cancellation: If you wish to cancel or put the project on hold, inform us at least 15 days in advance.
    • If the project has already started and runs for more than a week, the initial payment will not be refunded.
    • If you have paid more than the actual costs incurred, we may issue a partial refund, depending on the case.
  • Device Compatibility: Our website designs are fully responsive and tested on:
    • Desktop (1920×1080 px resolution)
    • iPhone, iPad, Samsung Galaxy Tab, and Galaxy S5 devices
    • If you need testing on specific devices, please discuss it in advance.
  • Domain & Hosting: Our website development/design cost does not include domain registration or hosting services, unless explicitly mentioned. We provide hosting support to help you set up your website on third-party hosting providers such as AWS, Google Cloud, DigitalOcean, Vultr, etc. We do not own or provide hosting services directly.
  • Data Backup Responsibility: You must keep a backup of your website and database after project completion. We are not responsible for hosting provider-related issues, data loss due to hosting cancellation, or service suspension.

 

Revisions Policy

 

  • Landing Pages & Promotional Websites: One free revision, additional revisions will incur charges.
  • Standard Website Projects: Three free revisions, additional revisions will be billed.

 


 

Basic Annual Maintenance Package Terms

  1. Support Turnaround Time (TAT):
    • Standard support requests are handled within 24-48 working hours.
    • Most queries are resolved within an hour unless the issue is complex.
  2. Minimum Commitment:
    • Maintenance packages are for a minimum of 6 months, unless mentioned otherwise.
    • Monthly maintenance plans apply only to yearly contracts and are billed monthly via PayPal, Stripe, or other payment gateways.
  3. Scope of Maintenance:
    • Covers website issues, software bugs, and small content changes (max 2 hours per task/day).
    • Not included: Business Analysis, SEO, Digital Marketing, or Social Media support.
  4. Early Termination & Refunds:
    • If you cancel an annual or half-yearly contract early, refunds are given on a pro-rata basis with a 10% processing fee.
  5. Auto-Renewal:
    • If you want to cancel auto-renewal, notify us in writing at least one month before renewal.
  6. Late Payment Fee:
    • A $25 administrative fee applies for late payments or failure to renew on time.
    • We send a reminder 7 days before renewal.

 


 

PHP or Python Educational Projects

  • These projects are for learning purposes only and designed for students.
  • Professional use, modifications, or additional functionality are not covered, but can be requested for an additional cost.
  • No refunds for downloaded project files.
  • Bug fixes & setup support are provided.

 


 

Changes to Terms & Conditions

Hawkdive Technologies Private Limited reserves the right to modify or update these Terms & Conditions at any time. All changes will be immediately updated on this page.
